Welcome to Audair. By accessing or using our platform at audair.ai, you agree to be bound by these Terms of Service. Please read them carefully before creating an account or using any of our services.

1. Acceptance of Terms

By creating an account, accessing the Audair platform, or using any of our services, you confirm that you are at least 18 years of age and agree to these Terms. If you are using Audair on behalf of a business, you represent that you have the authority to bind that business to these Terms.

2. Description of Service

Audair is an AI-powered radio and streaming ad creation platform. We provide tools that allow users to generate voice-over scripts, produce audio advertisements, and download broadcast-ready audio files. We also facilitate media placement referrals through our Run My Ad service.

3. Account Registration

You must provide accurate and complete information when creating your account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at audairapp@gmail.com if you suspect unauthorized access.

4. Subscription Plans and Billing

Audair offers both free and paid subscription plans. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice.

You agree not to use Audair to create content that is:

6. Intellectual Property

You retain ownership of the content you create using Audair. By using our service, you grant Audair a limited license to process and store your content solely to provide the service. The Audair platform, technology, and brand are owned exclusively by Audair and protected by applicable intellectual property laws.

6b. Ownership & Commercial License

When you generate an ad using Audair, you are granted a perpetual, worldwide, royalty-free license to use, broadcast, distribute, and publish that ad for any commercial or non-commercial purpose — including radio, streaming platforms, social media, television, and any other medium.

Paid plan subscribers (Starter, Pro, and Agency) receive full commercial licensing rights with no restrictions on where or how often the ad is used.

Free plan users receive a limited personal use license. Commercial broadcast use requires an active paid subscription at the time of generation.

Audair retains no ownership over your generated ad content. You own what you create.

7. AI-Generated Content

Audair uses proprietary AI technology to generate scripts and voice audio.

8. Media Placement

The Run My Ad feature connects users with media placement services. Audair acts as a referral intermediary and is not responsible for media placement outcomes, campaign performance, or agreements made between users and media platforms or representatives.

9. Limitation of Liability

To the fullest extent permitted by law, Audair shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid to Audair in the 3 months preceding the claim.

10. Termination

Either party may terminate this agreement at any time. You may cancel your subscription through the billing settings. We may suspend or terminate your account for violation of these Terms. Upon termination, your right to access the service ends immediately.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Continued use of Audair after changes constitutes acceptance of the updated Terms.
